GENERAL TERMS AND CONDITIONS

https://www.seisdeltres.com (hereinafter referred to as the Website) is owned by Seisdeltres S.L. (hereinafter referred to as the OWNER), Tax Identification Number (CIF/NIF): B01824689, with its registered office at Camí Antic de Sant Cugat 137A, 08193 Bellaterra (Barcelona, Spain).

Access to, reproduction of, and use of the services available on the Website require prior acceptance of the Terms of Use in force at the time of access. The OWNER reserves the right to amend these Terms at any time by publishing the updated version on the Website. It is the user's responsibility to review the Terms of Use before accessing the Website's products and services. If you do not agree with them, you should refrain from using the Website.

OWNERSHIP

The Website is a composite work made up of various integrated and inseparable elements (including text, illustrations, photographs, animated images, videos, computer software, HTML source code and other materials), the Intellectual Property rights to which belong to the OWNER, except for materials used under licence from third parties.

The OWNER and its licensors shall at all times retain all Intellectual Property rights in the Website and in each of its individual components, including any copies made thereof, regardless of the medium on which such copies are stored. Only the rights of use expressly granted below are conferred. Any rights not expressly granted shall be deemed reserved.

In addition, the OWNER is responsible for the selection, structure, design and arrangement of the Website's content and has undertaken the initiative and assumed the investment required for its creation, digitisation and presentation. Accordingly, the Website, as a database, is protected under Article 12 and Title VIII of Book II of the Spanish Intellectual Property Act.

The OWNER is also the exclusive owner of the Website's design and visual identity and reserves the right to take any legal action against any person or entity engaging in imitation or unfair use thereof.

WEBSITE CONTENT AND DOWNLOADS. PERMITTED AND PROHIBITED USES

The following is permitted:

  • Browsing the Website, including accessing and viewing its content on a device. Temporary or incidental reproductions are permitted provided they are not intentional and form an integral and essential part of the technological transmission process. Access to certain sections of the Website may require prior registration.
  • Following prior registration where required, benefiting from the services and advantages made available by the OWNER to registered users, subject to the specific terms applicable to each section of the Website.

The following is strictly prohibited:

  • Any use of the Website, its content, downloadable materials or copies thereof that is contrary to applicable law, public morals or the principle of good faith.
  • Any use beyond the scope of personal, private use, particularly for commercial or professional purposes, including the sending of advertising or promotional communications and the collection or processing of third-party data.
  • Any extraction, public communication, distribution or transmission, in whole or in part, by any means, outside the scope of the authorised private use, including incorporation into any other work, website, publication, collection or database. The only exception is the publication by the media of downloadable materials available in the Press Room section.
  • Removing, concealing or altering any Intellectual Property or Industrial Property notices displayed on the Website or on any materials provided through it.
  • Any activities expressly prohibited elsewhere in these General Terms and Conditions or, more generally, any action that may interfere with the normal operation of the Website or adversely affect other users or third parties.

LINKS TO THE WEBSITE

  • Links and hyperlinks to the Website from other websites are permitted, provided they do not harm the public image or reputation of the OWNER, the Website, or any of the persons or products referred to therein. When linking to the Website, it is expressly prohibited to use techniques that may create confusion regarding the identity or ownership of the content, including framing or similar practices.
  • Links from websites whose content promotes or advocates, directly or indirectly, violence, discrimination, pornography or any unlawful activity are strictly prohibited. Likewise, links established for commercial purposes are expressly forbidden.

When creating links to the Website, it is expressly prohibited to use any content extracted from the Website without the prior written consent of the OWNER.

Under no circumstances shall links from third-party websites be construed as implying any relationship between the OWNER and the operators of those websites, nor shall they imply endorsement, sponsorship or recommendation by the OWNER. Accordingly, the OWNER accepts no responsibility whatsoever for the legality or content of such third-party websites.

USER CONTENT AND CONDUCT

As a customer or user of the Website, you agree to make appropriate use of the content and services provided and, in particular, you undertake not to:

  1. Engage in unlawful, illegal or activities contrary to good faith or public order.
  2. Publish or distribute content or propaganda that is racist, xenophobic, pornographic, promotes terrorism or infringes human rights.
  3. Cause damage to the physical or logical systems of the OWNER, its suppliers or third parties, or introduce or distribute computer viruses or any other physical or logical systems capable of causing such damage.
  4. Publish or distribute content that damages the image or reputation of the OWNER or third parties.
  5. Infringe the Intellectual Property, Industrial Property, image rights, honour or any other rights belonging to the OWNER or third parties.

The OWNER reserves the absolute right to decide whether or not to publish any contributions or messages submitted to the Website and may remove them at its sole discretion.

Any breach of these Terms of Use, and in particular of this section, shall entitle the OWNER to terminate the user's or subscriber's access to the Website immediately.

DATA PROTECTION

Any personal information or data you provide will be processed in accordance with our Privacy Policy. By using this Website, you consent to the processing of such information and confirm that all data you provide is accurate, truthful and up to date.

AMENDMENTS

The OWNER reserves the right to modify the Website at any time without prior notice, including changing, removing or adding content or services, as well as altering the manner in which they are presented or made available.

Although the OWNER makes every reasonable effort to ensure that the information contained on the Website is accurate, up to date and free from errors, no guarantee is given as to its completeness or accuracy. LEGAL ACTION

The OWNER shall pursue any breach of these Terms of Use, any improper use of the Website or its content, and any infringement of its rights or those of its licensors, particularly Intellectual Property and Industrial Property rights, by exercising all civil and criminal remedies available under applicable law.

GOVERNING LAW AND JURISDICTION

Any dispute or claim arising out of or relating to these Terms and Conditions shall be governed by the laws of Spain. Any legal proceedings shall be subject to the jurisdiction of the courts and tribunals corresponding to the user's or customer's place of residence, where required by applicable consumer protection legislation.
